What is a Guideline Rate / Circle Rate?
The Guideline Rate (also called Circle Rate or Collector Rate) is the minimum government-notified price for property in a given area. It is used to calculate stamp duty and registration fees. The actual transaction must be registered at the higher of the declared price or the guideline rate โ you cannot save stamp duty by underreporting price.
What is stamp duty in Chhattisgarh?
Stamp duty in CG (FY 2025-26): 5% for male buyers, 4% for female buyers (1% women concession), 4.5% for joint M+F. Plus 1% local body cess + 0.2% Upkar cess. Total stamp component: ~5.2% female / ~6.2% male.
What is registration fee?
Separate from stamp duty, registration fee is 4% of property value in CG, paid to the Sub-Registrar at the time of deed registration. Plus a service charge (~โน1,200).
Is TDS applicable on property purchase?
Yes. Section 194-IA of Income Tax Act: Buyer must deduct 1% TDS if property value exceeds โน50 Lakh. Deposit via Form 26QB within 30 days. Failure attracts interest + penalty.
Is GST applicable on property?
Only on under-construction property: 5% (without ITC) for residential, 1% for affordable housing < โน45L. Ready-to-move (with completion certificate) has NO GST. Land sales never attract GST.
What is the women buyer benefit?
In CG, female buyers get 1% concession on base stamp duty (4% instead of 5%). On a โน1 Cr property, this saves โน1 Lakh. Buy in your wife/mother's name to save.
What is mutation?
Mutation (Naam Antaran) is the process of transferring property ownership in municipal/revenue records after a sale or inheritance. It updates the Khatauni record. Without mutation, you legally own the property but municipal records still show the previous owner. Must do after every sale or death.

What is an Encumbrance Certificate (EC)?
EC shows the complete chain of registered transactions on a property over a period (usually 13-30 years). Apply at Sub-Registrar office for ~โน250. Critical before buying any property โ confirms there are no mortgages, liens, or disputes.
What is Khasra and Khatauni?
Khasra: A unique survey number identifying a parcel of land in revenue records (with area, boundaries, soil type). Khatauni: A record showing the owner(s) of a Khasra (Form B-1). Both are issued by Patwari (revenue inspector). Get the digitally-signed online version from CG land records portal.
What is Patwari Halka?
A Patwari Halka is a revenue administrative unit covering a few villages, headed by a Patwari. Every property has a Patwari Halka number. For example, Mathpurena = Halka 105, Mowa = Halka 39/45/109.
Capital Gains Tax on Selling Property?
Long-Term (>2 years holding): 20% tax on indexed capital gains. Short-Term (<2 years): Slab rate. Save tax by reinvesting in another residential house (Sec 54), in NHAI/REC bonds (Sec 54EC, up to โน50L within 6 months), or in Capital Gains Account Scheme.
What is Indexation?
Indexation adjusts the purchase cost for inflation using the Cost Inflation Index (CII) published by CBDT. Example: โน10L purchase in FY 2001 (CII=100) becomes effective โน39L in FY 2025 (CII=390). Without indexation, all gain (โน15L sale โ โน10L cost = โน5L) would be taxed. With indexation, gain (โน15L โ โน39L) = -โน24L = no tax, in fact a loss to set off.
Why is "Bigha" different in every state?
Bigha is a non-standard traditional unit. Each state defines it differently โ CG/Bihar/MP/UP/Bengal all have different sizes. CG uses ~27,225 sqft for 1 Bigha (same as Bihar). Always confirm the local definition before any transaction.
What documents do I need to register property?
PAN card, Aadhaar, passport-size photos (both parties), original sale deed (draft), index registration ID for prior owner, latest khasra/khatauni, encumbrance certificate, property tax receipts (paid up to date), bank passbook copy for cheque payments, and any agreement to sell. Take a registered advocate for drafting.
Where do I register the deed?
At the Sub-Registrar office in whose jurisdiction the property lies. For Raipur city, there are 3 SR offices (SR-1, SR-2, SR-3) covering different wards. Both buyer and seller must be physically present (or represented via valid POA) with photos and IDs. Bring 2 witnesses with ID proof.
What is the difference between Carpet, Built-up and Super area?
Carpet area: Pure usable internal floor area (after walls). Built-up: Carpet + walls thickness (~15% extra). Super area: Built-up + share of common areas (lobby, lifts, parking, gardens โ ~25-35% extra). RERA mandates carpet area disclosure; don't buy based on Super area alone.
